The Supreme Court received West Bengal Chief Minister Mamata Banerjee on this day through her appearance in a Supreme Court case which she brought forward against the Election Commission of India (ECI) through a highly unusual and dangerous legal procedure. The ongoing SIR process in West Bengal serves as the core issue which Banerjee believes will result in “large-scale disenfranchisement” of voters before the upcoming 2026 Assembly elections.
The Chief Justice of India (CJI) Surya Kant leads the bench which is currently examining the case.
The Core Allegation: “Logical Discrepancies”
Banerjee used his January 28 writ petition to deliver a total condemnation of the Election Commission of India (ECI) through his formal legal document. The Chief Minister claims that the SIR process operates in a manner which hides information from public view while executing its tasks in a fast manner which violates constitutional standards.
The primary issue at stake involves voters who belong to the ‘Logical Discrepancy’ (LD) group. Banerjee argues:
Lack of Transparency: The list of individuals flagged for discrepancies (such as name mismatches or spelling errors) has not been uploaded online.
Denial of Opportunity: Without a public list, affected voters are being deprived of a fair chance to respond or rectify their status.
Suo Motu Corrections: The petition demands that minor spelling variations should be corrected by officials automatically based on existing records, rather than summoning voters for hearings.
The Ultimate Goal: Reverting to 2025 Rolls
Banerjee has requested the Apex Court to issue a major ruling which would enable the 18th Legislative Assembly elections to proceed using the current 2025 Electoral Rolls because she views the revision process as entirely untrustworthy.
Key Demands Made in the Petition
The Chief Minister has asked the Supreme Court for multiple particular reliefs.
Scrap the SIR: Set aside the ECI notifications dated June 24 and October 27, 2025.
Aadhar as Proof: Direct the ECI to accept Aadhaar Cards as definitive proof of identity for discrepancy cases.
Withdraw Micro-Observers: The petition seeks the removal of ECI-appointed Micro-Observers from the state, or at least a restriction on their statutory powers.
Local Disposal: Local officers (ERO/AERO) should gain authority to resolve cases which require inter-state document verification after a delay of five days.
Stop Bulk Deletions: The process should prevent all legitimate voters from being removed from the voter rolls because of “unmapped” or “logical discrepancy” designations.
Why This Matters
The upcoming elections in West Bengal have turned the integrity of the voter list into a major focus for both political campaigns and legal battles. Banerjee uses her role as case presenter to demonstrate how serious the situation has become while she presents the ECI’s actions as a threat to the electoral rights of all Bengali voters.
