USA Issues Strict Warning: Key Instructions for Indians Amid Visa Rule Changes

There has been a notable transformation in the H-1B visa issuance process in the USA, and the foreigners, particularly the Indians, are alerted that they have to abide by the law in America. The new visa distribution regulations, which the US Citizenship and Immigration Services (USCIS) published in the Federal Register, will come into force on February 27, 2026.

The United States government has informed that the stricter immigration checks, the delay in obtaining H-1B and H-4 visa appointments, and the increased scrutiny of their social media have put hurdles for Indians who are in the US or travelling. The US government has therefore cautioned that noncompliance with US laws could result in criminal prosecution and heavy fines. Besides, the US Embassy in India said in a social media message that the warning had been given further publicity, thus underlining the government’s firm intention to control illegal immigration and protect the country’s security.

Meanwhile, the new H-1B visa system will apply to the FY 2027 cap registration season. Unlike the current lottery-based process, visas will no longer be issued randomly. Instead, priority will be given to highly skilled professionals and higher-wage earners. Entry-level and lower-paid applicants are expected to receive reduced preference.

In favor of this transformation, the U.S. Department of Labor has adjusted its wage policies for H-1B workers, giving the salary brackets a decisive role in the visa drawing. These alterations are probably to have a huge effect on the number of hopeful candidates, especially Indians, who are still the biggest group among H-1B visa holders.
